Welcome to the Collectr API! Our mission is to empower the community of collectors by providing access to valuable data and resources.
By accessing or using the Collectr Application Programming Interface (the "API"), you agree to be bound by these Terms of Service ("API Terms"), regarding the use of our API and any of the materials, code, data or content from getCollectr.com, and its related sites and pages (the "Site") and mobile app (the "App") (collectively, "Collectr Content"), which are in addition to the general Terms and Conditions available at www.getcollectr.com/terms-and-conditions.html. If there is any conflict between the API Terms and the General Terms and Conditions, the API Terms shall take precedence in relation to your use of the API.
Our API provides access to data and services aimed at supporting the infrastructure, servers, and maintenance of Collectr. By using the API, you contribute to the ongoing development and sustainability of our platform.
If you would like to use, or access the API, please register for an account at http://getcollectr.com/api. If you are requesting access on behalf of an organization, you represent and warrant that you are authorized to act on behalf of, and have the authority to bind, the entity that you represent and that is being issued an Application Key (defined below), to these API Terms. Collectr has sole discretion to grant or deny any request for API access and may seek further information before making a decision.
YOU ACKNOWLEDGE THAT ANY VIOLATION OF THE COLLECTR TERMS OF SERVICE, TERMS AND CONDITIONS, PRIVACY POLICY OR OTHER COMMUNITY GUIDELINES PROVIDED BY COLLECTR WILL BE DEEMED A BREACH OF THESE API TERMS AS WELL.
Collectr reserves the right, at its sole discretion, to modify or replace these API Terms, in whole or in part, for any reason at any time. Collectr will send a copy of any material changes to these API Terms to the email address you provided at registration. You are responsible for keeping the contact information you provided to Collectr current and ensuring our communications are not blocked by email filters. We also ask that you regularly check our Site because we will post updates to the API Terms there as well, and your continued use of the API after we post changes to the API Terms will constitute your acceptance of those terms. Collectr may, in the future, offer new services and/or features through the API. Such new features and/or services shall be subject to the terms and conditions of these API Terms.
Subject to these API Terms, Collectr grants you a non-exclusive, non-transferable, limited license to access and use the API solely for the purpose of retrieving product information on collectibles and integrating this information within your service or application, in accordance with the documentation provided by Collectr.
Collectr will provide you with confidential security keys that permit you to access the API ("Application Keys"). You may not share or transfer your Application Keys to any third party. We may revoke your Application Keys at any time.Except for the limited licenses granted by these API Terms, Collectr owns and retains all rights (including intellectual property rights), title and interest in and to the API, Collectr trademarks and logos, Collectr Confidential Information, and any content created or derived therefrom ("Collectr IP").
Any rights not expressly granted to you hereunder are reserved by Collectr or its suppliers. You will not take any action inconsistent with Collectr's ownership of the Collectr IP.Collectr shall have the right to monitor and audit your use of the API to make sure you are abiding by these API Terms or to improve the service. You will not seek to block or otherwise interfere with the monitoring or audit, and Collectr may use technical means to overcome any methods you may use to block or interfere with such monitoring. Audits may also include requests for documents and information. If we believe that you or your service providers are violating these API Terms, or any laws, rules, or regulations, we may prevent you from further accessing or using the API.
All services which utilize or access the API shall display the following notice prominently within your software application, mobile app, website or other interface: "Powered by Collectr." You may use the Collectr name or logos to identify the source of the API content source. You may not use the Collectr name, logo, or the like to imply endorsement of any product, service, or entity, not-for-profit, commercial, or otherwise.
Your use of the API may be subject to limitations on access, calls, or use as determined by Collecr. If Collecr believes you have attempted to exceed or circumvent these limits, your ability to use the API may be permanently or temporarily blocked.
If you wish to terminate these API Terms, you must refrain from further use of the API, and you must delete any Collectr Content in your possession or control.
Collectr reserves the right, though not the obligation, for any reason at its convenience to (1) refuse to provide the API to you, or (2) terminate or deny you access to use of all or part of the API at any time for any reason at its sole discretion.The API is provided "as is" and on an "as available" basis. Collectr makes no representations or warranties of any kind, expressed or implied, as to the performance or operation of the API. You expressly agree that your use of Collectr's information, content and products is at your sole risk.
Collectr hereby disclaims all warranties of any kind, express or implied, including without limitation the warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, and non-infringement. Without limiting the foregoing, Collectr makes no representation or warranty that the API will be error-free or accurate, that access thereto will be continuous or uninterrupted, or that the API is free of viruses or other harmful components. Furthermore, Collectr will not be liable for any damages or loss caused by the use of the API.Collectr will not be liable for any indirect, incidental, punitive or consequential damages arising out of or in connection with the API, the Collectr IP, or the subject matter of these API Terms.
To the fullest extent provided by law, Collectr will not be liable to you for more than the greater of (a) the total fees paid to Collectr by you during the one-month period prior to the act, omission or occurrence giving rise to such liability, or (b) or $50.You hereby warrant that (1) your use of the API will be in strict accordance with the Privacy Policy, Terms of Conditions, these API Terms, and all applicable laws and regulations, and (2) your use of the API will not infringe or misappropriate the intellectual property rights of any third party.
You agree to indemnify and hold harmless Collectr, its affiliates and its and their directors, officers, contractors, employees, agents, successors and assigns from and against any and all claims loss, damage, liabilities, and expenses, including without limitation attorney's fees, arising out of (a) your use of the API, (b) your breach of any term of these API Terms; or (c) any actual or alleged (direct or indirect) infringement or misappropriation of intellectual property rights by your software application, website or other interface.
These API Terms (including any other terms or documents expressly referenced or incorporated herein) constitute the entire agreement between Collectr and you concerning the subject matter hereof, supersede all prior understandings and communications between Collectr and you, oral or written, and may only be modified by the posting of a revised version of these API Terms by Collectr. These API Terms are personal to you, and you may not assign or delegate your right and/or duties under these API Terms to anyone else and any attempted assignment or delegation is void. You acknowledge that we have the right to seek an injunction, if necessary, to stop or prevent a breach of your obligations under these API Terms. If for any reason a court of competent jurisdiction finds any provision of these API Terms to be unenforceable, the provision of these API Terms will be enforced to the maximum extent permissible so as to effect the intent of the parties, and the remainder of these API Terms will continue in full force and effect. For purposes of this Agreement, (a) the words "include," "includes" and "including" are deemed to be followed by the words “without limitation”; and (b) the word "or" is not exclusive.
You agree that any claim, cause of action or dispute you have against us that arises out of or relates to these API Terms or our Site, will be resolved exclusively in an Ontario Court of Justice. You also agree to submit to the personal jurisdiction of either of these courts for the purpose of litigating any such claim, and that the laws of the Province of Ontario will govern these API Terms and any claim, without regard to conflict of laws and principles thereof.
Collectr's failure to exercise or enforce any right or provision of these API Terms shall not constitute a waiver of such rights or provision. No waiver by Collectr will have effect unless such waiver is set forth in writing, signed by us. No waiver of any breach or default in one instance will constitute a waiver of any subsequent breach or default.
You (a) consent to receive communications from us in an electronic form, whether via email or posting on the developer portal or other reasonable means; and (b) agree that all terms and conditions, API Terms, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications would satisfy if it were in a writing.
